On Monday, the 12. November 2018, the world's largest medical technology trade fair the internationally renowned ‘MEDICA’ once again opened its doors in Düsseldorf, Germany. Over the course of four days, around 120,000 trade visitors were informed about the latest developments in the medical industry sector. More than 5,000 exhibitors from almost 70 countries were represented. The international participation amounted to more than 80%. As an international company operating in around 100 countries worldwide, TROGE Medical has been presenting its products in Hall 6 at Stand F26 for more than 20 years. As every year, we presented innovative products that are distinguished by their high quality and ever increasing sophisticated requirements by the medical profession, especially as regards the protection against needle-stick injuries. The focus was on the following products:     

• TRO-ARTEROCATH safety, safety arterial cannula
• TRO-SOLUSET autostop (safety), infusion set with 'autostop' function, protection against needle-stick injuries
• Further generations of safety products in infusion therapy, e.g. TRO-VENOCATH y-flex, IV cannula with extension tube.

During the past years the EPO‘s Technical Board of Appeal has legally revoked several basic patents of the company B. Braun Melsungen AG for intravenous safety catheters, most recently the European patent EP 1 911 487 with its final decision in May 2017.

In 2014 the Board of Appeal had previously revoked the European patents EP 1 604 700 and EP 1 911 486. All these patents were targeting a needle tip cover and its interaction with the catheter shaft. In September 2014 the European patent EP 1 545 681 was legally revoked by the EPO’s Technical Board of Appeal as a result of an appeal by another competitor. This patent concerned a combination of a needle tip cover and a valve device.

In all four cases the European Patent Office ruled that B. Braun had applied for protection of an item which is, in fact, not described as such in the patents. B. Braun had thus expanded all four patents in an improper way.

B. Braun has no further means of complaint against this decision by the European Patent Office.

The revocation of European patents EP 1 604 700, EP 1 911 486 and EP 1 911 487 means that B. Braun ultimately could not prevail in the parallel patent infringement proceedings in Germany, Spain and Italy. Through these patent infringement proceedings B. Braun has unsuccessfully tried to keep competitors off the market. The District Court Düsseldorf, following the ruling of the European Patent Office, has  dismissed a patent infringement suit by B. Braun, based on the German part of the European patent EP 1 604 700, with costs, and has increased the value in litigation due to the importance of the case for the parties. In an earlier interim injunction procedure related to patent EP 1 911 486, the Higher Regional Court had raised massive doubts regarding the validity of this patent, and had dismissed B. Braun’s injunction with costs. A dismissal with costs of B. Braun’s complaint about the legally revoked patent EP 1 911 487 in May 2017 is pending. The parallel infringement procedures in Spain and in Italy proved to be unsuccessful for B. Braun based on the missing validity of the enforced patents.
